Seller's Declaration

1. I (We), the Owner(s) of

(the "Horse") wish to consign this Horse to the Canadian Warmblood Auction, which shall be offered for sale at public auction in accordance with the Terms and Conditions of Sale. I (We) have read, agreed to and understand the Terms and Conditions of Sale.


2. For its services, Canadian Warmblood Auction shall receive and retain from the proceeds of the sale as a commission from the Seller an amount equal to the scaled percentage of the final bid on the Horse as laid out in the Nomination Package.


3. I (We) understand that if the Horse is withdrawn from the sale to be sold between when the catalogue is posted and the sale close, a commission of 9% based on the previous 3 year sale price average of the Horses’ will be owed.


4. I (We) hereby represent and warrant as follows:

a. We are the owners of the Horse and as such have the right to consign the Horse for sale;

b. The Horse is, and until the completion of the sale by Canadian Warmblood Auction will be, free and clear of all financial encumbrances, options to purchase, rights of first refusal, and other

restrictions on the right to offer and sell the Horse at auction; and

c. Good title to the Horse will pass to the Purchaser free and clear of any such encumbrances or restrictions.


We further agree that the representations and warranties contained herein shall survive the completion of the sale of the Horse, and we shall notify Canadian Warmblood Auction immediately in writing of any events

or circumstances that may cause the foregoing representations and warranties to be inaccurate or breached in any way.


5. I (We) hereby forever release, remise and discharge Canadian Warmblood Auction from any and all liability to ourselves and our heirs, executors, administrators, successors, and personal representatives from any and all actions, causes of action, loss, damage and any claims or demands for such loss or damage of every kind and nature whatsoever, at law, in equity or pursuant to statute arising from any Injury we may or which may be sustained by any persons, horses or equipment as a result of attending or participating in the sale.
